This agreement

These Terms are an agreement between you and Palaxy Game about the Snake Express mobile game (com.palaxygame.snakeexpress.puzzlegame) and this website. By installing or playing the game you accept them. If you do not accept them, do not install the game, and uninstall it if you already have.

If you are under 18, read these Terms with a parent or guardian. The game is intended for players aged 13 and over.

What you may do with the game

We give you a personal, non-exclusive, non-transferable, revocable licence to install and play Snake Express on devices you own or control, for your own entertainment. The game is licensed to you, not sold.

You may not:

• Copy, sell, rent, sub-licence or redistribute the game or any part of it.
• Modify, decompile or reverse engineer it, except as far as the law in your country says you may regardless of this clause.
• Use cheats, modified clients, emulators driven by scripts, automation or memory editors to change coins, boosters, levels or anything else the game tracks.
• Interfere with the ads, the analytics or the settings the game fetches.
• Use the game, its art, its name or its logo in your own product or promotion.

Coins, boosters and skins

Coins, Undo, Magnet and Extra seat boosters, chests and snake skins are virtual items inside the game. They are part of the licence above, not property you own.

• They cost no money. Snake Express has no in-app purchases. Coins are earned from trains, stars, combos, chests, the daily streak and rewarded ads.
• They have no value outside the game. They cannot be exchanged for money, transferred to another player or another device, or cashed out.
• Their prices and rewards can change. We balance the game from our servers, so what a booster costs or a chest pays may be different tomorrow.
• They live on your device. Reset progress, uninstalling, clearing app data, losing the device or switching to a new one takes them with it. There is no cloud save and no restore, and we cannot give them back.

Ads

The game is free because it shows ads. Rewarded ads are always your choice: watch one and you get the coins, booster or doubled reward it offers. An interstitial ad may appear between levels.

We do not control what an advertiser puts in an ad, and showing an ad is not an endorsement. Problems with an ad itself are for the advertiser or for Google, though we would still like to hear about one. How ads use data, and how to change your ad settings, is in the Privacy Policy.

Who owns what

Snake Express, its levels, artwork, snakes, trains, sounds, name and logo belong to Palaxy Game and are protected by copyright and trade mark law. Nothing in these Terms transfers any of that to you.

The game uses the Lilita One typeface under the SIL Open Font License, and open source Flutter packages under their own licences. Those licences cover those components only.

You are welcome to record, stream and post videos of your own play, including monetised ones, as long as you do not pass the game off as your own work or sell access to it.

Updates and availability

We may update the game, change how levels or rewards work, add or remove features, or stop publishing it altogether. Some of these changes reach your device from our servers without an app update.

We do not promise the game, its ads or its servers will always be reachable. The game is playable offline; the parts that need a connection may not always be there.

The app stores

You also agree to the terms of the store you installed from. Google and Apple are not parties to this agreement and are not responsible for the game, for support, or for any claim about it. On iOS, Apple is a third-party beneficiary of these Terms and may enforce them against you.

Support for Snake Express comes from us, not from the store. The contact page is the way to reach us.

Ending this agreement

You may end it at any time by uninstalling the game. We may end it if you break these Terms, in which case your licence stops and you must uninstall. The sections on ownership, disclaimers and liability carry on after it ends.

No warranty

The game is provided as it is and as it is available, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the game will be uninterrupted, error free, or free of anything harmful. Some countries do not allow these exclusions, so parts of this section may not apply to you, and nothing here removes a consumer right you have under the law of your country.

Limits on our responsibility

To the fullest extent the law allows, Palaxy Game is not liable for indirect, incidental, special or consequential loss, for lost data, or for lost virtual items, arising out of your use of Snake Express.

Where liability cannot be excluded, it is limited to the greater of the amount you paid us for the game in the twelve months before the claim, which for a free game is nothing, or ten US dollars. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Governing law

These Terms are governed by the laws of India, without regard to its conflict of law rules, and the courts of India have jurisdiction over any dispute. If you are a consumer in a country whose law gives you the right to bring a claim at home, this clause does not take that right away.

Changes to these Terms

We may change these Terms as the game changes. The date at the top of this page says when the current version took effect, and carrying on playing after that date means you accept it. If a change is significant, we will say so in the game or on its store listing.
